It has been over three years since Intel Corporation was ordered by a federal jury to pay VLSI Technology LLC over $2 billion in damages. During that time, the patent damages jury verdict was overturned and, despite many recent case updates, a new trial on damages remains pending.
In this review and analysis, James Donohue and Marie Sanyal provide an update on the VLSI-Intel case and identify more than 50 other patent infringement damages jury verdicts since 2018 that have similarly been overturned. Collectively, these overturned verdicts involve more than $10 billion in damages awards.
