IP Literature Watch: December 2024

January 7, 2025
Literature watch | Charles River Associates

We are pleased to present the latest edition of CRA’s IP Literature Watch. This issue contains pieces on antitrust & IP, licensing, litigation, innovation, law and policy, copyright, and trade.

Some highlights from the issue:

  • A chapter examining the legal foundations of character merchandising, or the authorized use of popular characters in various consumer products, including the role of copyrights, trademarks, and related intellectual property laws;
  • An article examining re-recording of music as a way for artists to better capitalize on the popularity of their music in the context of Taylor Swift’s success, interrogating common law reversion schemes in the context of sound recordings;
  • And a short essay considering the challenges in meaningfully differentiating copyright over otherwise identical works based on a level or nature of GenAI use, and in turn speculating on copyright’s sustainability in prospective digital economies with foundationally shifted modes of GenAI-supported creative production.
