On February 28, 2024, President Biden signed an executive order (EO), EO 14117, “Preventing Access to Americans’ Bulk Sensitive Personal Data and United States Government-Related Data by Countries of Concern.” This EO represents a significant and novel step by the US government to protect sensitive American personal data against exploitation. Under the EO, the US Department of Justice (DOJ) and the Department of Homeland Security (DHS) are directed to issue regulations and related security standards to implement the EO.
Simultaneously with the release of the EO, the DOJ issued an advance notice of proposed rulemaking (ANPRM) and related fact sheet, which shed light on the likely shape of these regulations. In this article, the authors summarize key takeaways from the EO and ANPRM.
