Mining companies today must manage a host of challenges including cost pressures, commodity price volatility, geopolitics, resource nationalism, and environmental and social issues. At the same time, surging demand for critical minerals such as battery metals, copper, platinum and rare earth elements is intensifying focus on the mining industry. As the stakes rise, so too does the risk of disputes. Over the past decade, arbitration has emerged as an increasingly popular method to resolve these disputes. – a trend highlighted by the growing number of high-profile investor-State arbitrations in the mining sector.

This interactive workshop offers practical lessons on mining disputes, including insights and current trends. The first panel will discuss hot topics through the prism of a fictional case study, with perspectives from arbitration counsel, in-house counsel, experts and funders. Together, they’ll be considering issues such as political risk, social licence and environmental protection, third-party funding and valuation. The second session will bring together two eminent practitioners, Audley Sheppard KC and Ania Farren, for a Q&A on their insights into mining cases, as well as general lessons from their arbitration careers.
