Dr. Debra J. Aron, CRA vice president, advised counsel for Defendants, and testified at deposition on class certification and damages in a purported class action alleging violations of the Telephone Consumer Protection Act (TCPA).
The Defendant, a large telecommunications company, had a policy of calling its customers whose payments were overdue. The Plaintiffs claimed that some of the calls were wrong numbers and were made to individuals who were not the company’s customers. The Plaintiffs claimed a wrong number could be determined though identifying the data of the person who answered. Dr. Aron analyzed the call records data and developed and executed a methodology for distinguishing between calls that may have been genuine wrong number calls, resulting from reassigned telephone numbers or other causes, and those that were to the right party, notwithstanding the wrong number claim purportedly made by the individual who answered the call.
The parties to the case reached a settlement before the case went to trial.
