A CRA consultant was engaged by Kirkland & Ellis on behalf of their clients, Lionbridge Technologies Inc. and H.I.G. Middle Market, LLC, in a trade secret misappropriation suit brought by TransPerfect Global Inc.
A Manhattan federal judge recently granted full summary judgment in favor of Lionbridge and H.I.G. after finding the plaintiff presented insufficient evidence to support their misappropriation claims and other theories of misconduct it pursued.
The Court also found that TransPerfect failed to show that it had been damaged by any of the alleged misconduct. The CRA consultant evaluated the plaintiff’s claims for damages and demonstrated that there was no proper economic foundation to support plaintiff’s theory of damage and explained the multiple deficiencies in the plaintiff’s proposed measurement of damages.
In a January 2024 decision from the Second Circuit Court of Appeals, a three-judge panel affirmed a lower court decision that granted summary judgment to Lionbridge and H.I.G. Middle Market LLC, and dismissed TransPerfect’s allegations of breach of a confidentiality agreement and trade secret misappropriation.
