CRA and Vice President Erik Himan were retained by plaintiffs in a matter in the Delaware Court of Chancery arising from the alleged breach of the confidentiality and non-compete provisions of an agreement related to the purchase of a company in the home healthcare industry. Mr. Himan was asked to provide his opinion on the lost profits (damages) to the purchaser as a result of the defendant’s alleged breach of the terms of the agreement and to also provide an opinion as to whether plaintiffs would suffer irreparable harm if the Court did not extend the injunctive relief within the Court’s prior temporary restraining order.
Following the submission of Mr. Himan’s expert report and his deposition testimony, plaintiffs entered into a favorable settlement with the defendants.
