ITC Section 337 trial testimony on domestic industry for patented medical devices

CRA’s team of intellectual property experts provided expert testimony regarding the economic prong of domestic industry in an ITC Section 337 investigation related to patented implantable medical devices. CRA’s consultants analyzed the significance of domestic industry investments in multiple labor and cost categories at two US facilities and applied various metrics to allocate investments to the domestic industry products. CRA’s team of experts also examined realities of the marketplace in determining whether certain investments related to non-patented components used in conjunction with patented components should be considered. The ALJ and Commission adopted CRA’s domestic industry conclusions.
