CRA’s Intellectual Property experts were retained by a multinational consumer goods corporation to assess damages in a litigation involving alleged copyright infringement and rights of use issues related to digital images of an individual. The allegations stemmed from the alleged improper use and distribution of copyrighted images on product packaging and brochures and in digital advertising for a leading skin care brand after expiration of a licensing agreement. Our team conducted an independent assessment of the nature and use of the asserted copyrights, related license agreements, industry licensing practices, and actual and profit-based damages associated with the alleged infringement.
