The EC opened an investigation into practices related to a non-solicitation agreement between two major manufacturing technology companies.

A CRA team including Mikaël HervéChara TzanetakiMariam Arutyunyan, and David Meijer advised one of the companies during the European Commission’s investigation.

The team analysed the rationale and the effects of the non-solicit obligation, providing a mix of theoretical and empirical evidence on the impact of the conduct on both labour (engineers) and product markets.

After years of investigation, the Commission ultimately concluded that there was insufficient ground to further pursue its investigation.
