CRA assists client in averting no-poach charges

In response to a Department of Justice allegation of unlawful employment restrictions via an alleged no-poach agreement, CRA Labor & Employment experts were retained to assess employee movement within the relevant industry and among the employers at issue.

Using client-specific and publicly available data, CRA demonstrated that employee movement before and after the alleged agreement did not differ in a statistically meaningful way. CRA further demonstrated that the employers in question constituted a minority of the demand within their relevant labor market. The DOJ investigation concluded without charges being filed.
