CRA assisted counsel to a class of Qualcomm investors in achieving a $75-million settlement, providing counsel with critical expert services.
The investors had alleged that Qualcomm had misled the market by stating that it was keeping its licensing and chip-supply business separate, while bundling the negotiations and the terms of their patent licenses and chipset agreements. According to investors, this settlement was the first instance any plaintiff has achieved any recovery from Qualcomm in any of the related alleged anti-competitive conduct proceedings.
Professor Timothy Simcoe provided expert economic analyses at both the class certification and merits stages of the litigation, opining on the economic aspects of Qualcomm’s chip-supply and licensing businesses, bundling practices, and FRAND commitments in SEP licensing. CRA’s team was led by Nadia Soboleva and John Hayes. The case In Re: Qualcomm Inc. Securities Litigation was filed in the United States District Court for the Southern District of California, and the court approved the final settlement.
