CMA closes its merger inquiry into the Microsoft/OpenAI partnership

On 5 March 2025, the Competition and Market Authority (CMA) closed its merger inquiry into the Microsoft/OpenAI partnership.

The CMA investigated whether the terms of the partnership led to Microsoft exerting de facto control over OpenAI and whether the benefits brought by the partnership could be outweighed by a lessening of competition in the AI and Foundation Model space. The CMA concluded that there was no basis to review the partnership under the merger regulations.

A CRA team including Dr. Oliver Latham, Dr. Matteo Foschi, Dr. Mauricio Chikitani, Jakub Drabik, Liam Connolly, and Steven Yang advised Microsoft on the matter.
