CRA was retained by counsel for Cigna Corporation in a litigation in Delaware Chancery Court arising from its unsuccessful merger with Anthem, Inc. Both companies sued for damages related to alleged breaches of the merger agreement. A CRA Senior Consultant and Harvard Business School Professor Richard S. Ruback testified at trial on potential damages to Cigna and Anthem. CRA Vice President from the Competition Practice, Monica Noether, also testified at trial on antitrust issues. The Court’s ruling on liability issues “leaves the parties where they stand. Neither side can recover from the other.”
