Analysis of millions of call records to identify only calls relevant to purported TCPA class

Dr. Debra Aron, vice president, advised counsel for the Defendants, and gave deposition testimony on class certification and damages in a purported class action brought under the Telephone Consumer Protection Act (TCPA). The Defendant operated a calling platform utilized by agents to contact potential customers in telemarketing efforts on behalf of multiple companies.

Dr. Aron assessed the accuracy of the data analysis performed by the Plaintiff’s expert and the relevance of the analysis to the allegations in the case. The data produced contained records of several million telephone calls and the audio recordings of a subset of those calls. By using systematic techniques to analyze the call records, in conjunction with the deposition testimony, documentation produced, and the audio recordings, Dr. Aron was able to identify the subset of alleged violating calls that, according to the Defendant’s theory of the call flow and theory of liability, were made on behalf of the Defendant.
